Overview

A criminal case can change a person's life quickly. An FIR, a police call or an arrest raises urgent questions about liberty, reputation and family. Advocate Himanshu Sharma appears for accused persons and for complainants in Gurugram courts and advises on every stage, from the first police contact to trial and appeal.

Early advice matters. What you say to the police, how you respond to a notice and how quickly you apply for bail can all shape the result. Please speak to us before taking any step you are unsure about.

Bail

Bail is the first priority in most criminal matters. If you fear arrest, anticipatory bail may protect you in advance. If you are already in custody, an application for regular bail is made before the magistrate or the sessions court, depending on the offence.

Courts consider the seriousness of the allegation, the evidence collected, the risk of absconding or tampering with evidence, and the accused person's background. We prepare each application on these points and argue for conditions you can comply with.

FIR, investigation and quashing

If you are a victim, we help you lodge a complaint and pursue it if the police do not act. If you are named in an FIR that you believe is false, exaggerated or the result of a private dispute, there may be grounds to ask the High Court to quash it. We study the FIR and the material available before advising whether this is realistic.

During investigation, we advise you on your rights, on cooperating with the police lawfully, and on what to avoid saying or signing.

Trial and appeal

A criminal trial involves framing of charges, prosecution evidence, cross examination, the accused's statement and final arguments. We prepare witnesses, test the prosecution case and present the defence clearly. For complainants and victims, we assist the court and follow the progress of the case.

If a conviction or acquittal is wrongly decided, an appeal or revision may be available within a limited time. We examine the judgment and advise whether to challenge it.

What to do now

  • Stay calm and do not sign blank or unread papers
  • Keep copies of every notice, summons and FIR
  • Do not contact or threaten witnesses
  • Write down the sequence of events while it is fresh
  • Call us before attending the police station if you can

Common questions

Can I get bail in every case? Not in every case, but bail is the rule in many offences and the court decides on the facts.

Can an FIR be cancelled? Sometimes, by the High Court or by settlement in suitable cases.

Do I need a lawyer at the police station? You have the right to consult a lawyer, and it is wise to do so.
